NCCPA SOLIDARITY TO STRIKING DEFENCE WORKERS

 

The Defence workers united forum had decided to embark upon the deferred indefinite strike action from 26^th July, 2021 onwards, having failed to elicit any response from the Government for a negotiated settlement on the issue of corporatisation of the 41 Ordnance factories. These factories which have served the Nation for more than two centuries had been instrumental in meeting the defence needs or enabling the country to be self-reliant, presently await the decision for dismantling to be  put into operation.  The change of ownership which is to be effected through the process of corporatisation  is not necessitated by the viability or profitability question. No allegation has been made either of  the quality of its products or the cost of operation.  Ostensibly the decision was taken to enable the cronies of the ruling party to take over the lucrative business. 

At the last meeting of the JCM National Council held on 26^th June, 2021, the issue came up prominently in the discussions.  In a subtle comment, the Cabinet Secretary had indicated that corporatisation being a policy decision is well within the province of the Government and therefore unquestionable.  On the question of the fate of the workers in the event of the structural and ownership change, there had been unfortunately no response but a stony silence. 

Envisaging that the ensuing strike action will receive the fullest support and cent par cent participation of the workers and the factories might come to a grinding halt, for even the ruling party led Federation has decided to join the struggle, the Government have now decided to invoke the dreaded ESMA and make use of its draconian provisions to threaten the leaders and cadres of the movement. 

Both the NJCA and Confederation have called upon its affiliates to support the struggle of Defence workers and be part and parcel of the Black day protest action on 8^th July, 2021. NCCPA calls upon its affiliates and through them every member to publicly denounce the Government’s decision to invoke ESMA to suppress the movement of Defence workers who have decided to fight for the greatly reasonable demands.  The Units may kindly get in touch with the Associations of the working employees of the respective stations and take suitable decision as how to organise the protest day demonstration.

              The 48^th meeting of the National Council JCM was held today under the  chairmanship of the Cabinet Secretary.  As a member of the  Standing Committee, National Council, the undersigned participated in the meeting.  The decisions taken on various issues raised are contained in the letter of the Secretary, Staff Side, JCM, Com.Shiv Gopal Mishra, who is also our President.  On expenditure department related items, the official side has offered to hold a bilateral discussions with the Staff Side.  As you are aware, most of the issues are pending disposal at their end. 

              The question of DA/DR was raised by the Staff Side expecting some positive response from the Government.  As expected the orders, if at all agreed by the Cabinet, will only be issued in September 2021 as I s the practice with the release of July related Dearness allowance/Relief. The Health Ministry has promised to hold a bilateral discussion with the staff side in the matter of health insurance scheme.  Now that our proposal is with the government we may expect a fruitful discussion on the issue.

2.      Grant of Medical Advance to the Central Government Employees.

3.      Reimbursement of additional charges paid on account of overstay in the hospitals.

4.      Hospital Patient Care Allowance for C.G.Employees working in Hospital.

5.      Statement of following COVID-19 related issues.

6.      Evolve a Health Insurance Scheme for all employees and pensioners to cover up all pensioners who are outside the ambit of CGHS.

20.  Grant of Gazetted Status to Senior Section Engineers of Ministry of Railways.

21.  Grant Recognition to all employees organizations fairly and transparently – restore function of departmental and office councils in terms of the JCM Scheme.

22.  JCM Coverage to all PB-1 and PB-2 Officials by treating them as deemed Group C only.

23.  Litigation cases on service matters to be extended to all.

24.  Eradication of injustice to Casual, Contract and Outsourced workers: providing them the right to form a Union in terms of Article 19. 1(C) of the Constitution of India.

25.  Fill up all vacant posts in all grades.

26.  Grant of 5 (five) effective upgradation to all Group B&C employees in entire service life.

27.  Undertake cadre review of all Groups – B&C Cadres in every five years before the cadre review of Group A Cadres.

28.  Grant of Risk Allowance to the Employees involved in permanent and perennial recognized Risk Operations.

29.  Grant of Night Duty Allowance in 7^th CPC scale without any basic pay ceiling limit.

Sub: Empanelment of AIIMS In Ranga Reddy District Telengana, Mangalagiri, Guntur District in Andhra Pradesh.

              As part of the scheme to bring super speciality hospital facilities to  all States of the country, the Government had set up AIIMS in Andhra Pradesh and Telengana.  In Telengana it is located in Ranga Reddy District and in Mangalagiri , Guntur District in A.P.  Both these hospitals have come of standard and have started functioning.  They have also become much sought after hospitals in these two States.  No doubt, the pressure on AIIMS Delhi has eased due to this step taken by the Government. 

               However, these hospitals have not yet been empanelled by the CGHS for treatment of the beneficiaries.  An urgent need has now come about due to the corona pandemic which has put pressure on all hospitals especially those in Government sector .  The beneficiaries in both the States have expressed their desire that these two AIIMS be empanelled.

               We, therefore, request you to kindly give necessary directions  to empanel the above mentioned two AIIMS as recognised hospitals for treatment of CGHS beneficiaries.  Since these hospitals are in Government sector and the rate they charge for different treatment procedures being on par with the AIIMS Delhi, we hope that the recognition of these hospitals may not pose any difficulty.

Kindly refer to the telephonic conversation we had yesterday .  As I told you, we are getting frantic calls from our senior comrades over the non payment of DR/DA and other covid related issues.  They are apprehensive of the Government further freezing the DA/DR and ultimately denying the payment of DA itself in future  Given the hollowness of the assurances held out by the bureaucrats on many previous  occasions,  we have reason to believe that the said apprehension is not totally misplaced.  They are of the opinion that a united action programme, howsoever simple it is, must be organised by the working employees and the pensioners together to highlight some of the pressing issues.  The National JCA which we had formed in the wake of the 7^th CPC  wage revision, will be the best suited platform for organising such an action.  Fairly almost all Federations of CGEs have representation in that set up .  The Pensioners Associations in the country have all followed the decision of the NJCA.  In the circumstances, it would be appropriate that you may convene a meeting of the NJCA through any virtual platform so that consultation with all concerned could be conducted and appropriate decisions taken.  I give hereunder some of the issues, which we might highlight for immediate resolution for an all out settlement of the earlier charter of demands appears to be a distant possibility. 

 

1.       Payment of DA/DR to all employees and pensioners with arrears; immediate issuance of the requisite orders.

2.       Implementation of the supreme court decisions considering them as decision  in ram especially in the following cases:

(a)    Notional increment for those who have completed one year piror to retirement I,.e. on 30^th June and 31^st December.

(b)    To give effect to the MACP scheme from 1.1.2006, which had already been done in the case of armed personnel;

(c)     Any other such decisions of the supreme court, which have already been subjected to discussions at the Standing Committee.

3.       Include the Central Government employees in the priority list of covid vaccination as they are required to discharge official functions even during the period of lock out.

4.       Declare all CGHS dispensaries/Wellness centres, Railways hospitals and dispensaries as vaccination centre where the Central Government will provide the vaccines;

5.       Payment of compensation (not less than 10 lakhs) to all those who died of covid. (The BSNL management has already taken such a decision in the matter)

6.       Provide compassionate appointments to the wards of all CG employees, who died since November, 2019 without adhering to the illogical ceiling of 5%

7.       Evolve a health insurance scheme for all employees and pensioners to cover up all pensioners, who are outside the ambit of CGHS;

8.       Take steps to revive all PSUs which are either closed down or privatised, which are capable of manufacturing vaccine in the background of the acute shortage as also the oxygen units

9.       Provide full wages to all workers who are engaged on daily rated basis even for the days they could not attend office due to covid related reasons.

10.   Any other issues which the meeting might consider important and required to be included

              We reproduce hereunder the extract from  the circular letter issued by the Confederation of Central Government employees and workers in connection with the observance of Black day on 26^th May 2021.  In the matters of common interest, you are aware, the NCCPA and the Confederation endeavours to function jointly.  In the present covid situation, whereby most of our cities and towns are under lock down a demonstrative action in front of Government offices is a rare possibility.  We, therefore, request our affiliates, State Units, CGPAs and other members to join the programme wherever possible or wear the black badges on 26^th May, 2021 even when you are at home. This is to convey our discontent and anger to the powers that be in a democratic manner.

Extract from the circular letter of the Confederation of CGE & Workers dated 23^rd May, 2021.

 

Dear Comrades,

 

              Kindly see the  Press Statement issued by the Central Trade Unions on 20^th May, 2021 calling upon all workers to observe 26^th May, 2021 as Black day.  The full text of the Press Statement has been placed on the Confederation’s website .

 

              Confederation, as you all know, had been part and parcel of the joint movement of the Trade Unions in the country, ever since the new economic policies were ushered in and implemented by the successive Governments that came to power at the Centre since 1991.  We endorse the call of the Central Trade Unions to observer 26^th May, 2021 as Black day.  We are aware that quite a number of cities and towns in our country are under lock down due to the rapid spread of the pandemic corona-Covid 19.  There are stipulations made by the respective State Governments in so far as maintaining social distance is concerned.  We request our members through our affiliates and State COCs to organise the protest programme adhering to those stipulations and taking care that our protest action in no way accentuate the  spread of the disease.  Kindly ensure that every member wears black badge on 26^th May 2021 and if possible badges indicating the issues on which we are agitated,  throughout the day .  Please also ensure that black flags are kept in the office compound   Written posters may be affixed in prominent places.  The State units might publish pamphlets or leaflets highlighting the following issues;

 

(a)    The denial and continued freezing of the dearness allowance/dearness relief instalments that have become due to the CGEs/CG Pensioners since January, 2020;

(b)    The nugatory attitude of the Government in settling the demands of the CGEs even those cases where the highest court of the country, the supreme court has given their decision in favour of the employees/pensioners;

(c)     The impasse created in combating the pandemic corona covid 19 due to the deficiency of vaccines; medicines, hospital beds, oxygen, ventilators, ICUs etc  which has resulted in the death of lakhs of people in the country.   As of today, the number of covid related death in the country has crossed the 3 lakh mark.  The above situation had been the product of the pernicious decisions emanating from the pursuance of the neo liberal economic policies, due to which the vaccine manufacturing  PSUS  were either closed down or hived off to the private entrepreneurs.  The crony capitalism by virtue of which the tax payers money is allowed to flow into the hands of selected Industrialists, which has become of theme of governance of the present government had been the single significant culprit for the present situation in the country;

(d)    The unhindered spread of obscurantist  and irrational beliefs by those occupying high positions in the Government and the society obliterating even whatever scientific temper exist in the society has accentuated the death toll and has created invincible impediments in the efforts of the health workers;

(e)    The continuous price rise of all petroleum products in the post-election fortnight  without any rhyme or reason, especially when the international crude oil prices has crashed  igniting inflation by the oil PSUs to make super profits out of human misery with the seal of approval of the government in power;

(f)      Withdrawing the benefits of both farmers and workers by passing legislations in the form of labour codes and farm laws and driving them to pitiable standard of living;

(g)    Refusing to render any assistance to the workers especially in the unorganised sectors who have lost their livelihood due to the lock down and corona;

(h)    The misuse and abuse of state power to imprison people who raise their voice in support of the poor workers and extreme intolerance towards dissenting views;

(i)      Above all the failure to provide  adequate health care facilities to the  people who are affected by the covid pandemic.
