FORUM OF CIVIL PENSIONERS ASSOCIATIONS
Memorandum to Central Government through the Honourable Governor
We submit on behalf of the Civil Pensioners to his Excellency the Governor of _______ for onward transmission to the Central Government our grievance arisen due to the adopting of validation clause of Pension Rules along with the Finance Bill 2025 in the Parliament on 25.03.2025.
On 25.03.2025, the Central Government had adopted the Finance Bill 2025 but along with it adopted the validation clause of Pension Rules also as part of the Finance Bill. The adopting of Validation Clause is against the Article 14 of our Constitution as per the earlier Supreme Court Direction in the Nakara Vs Union of India case in 17.12.1982 delivered by the Constitution Bench headed by Chief Justice Sri.Y.V.Chadrachud. The Court had said that any division of the homogeneous class of Pensioners as per their retirement year and implementing from a prospective date any rise to the future pensioners is violation to Article 14 of the Constitution.
The Central Government, now, through the validation clause of Pension Rules is resorting to divide the Pensioners as per their retirement date. Thus dividing the same class of Pensioners into past and future pensioners as per their retirement date and denying any benefit to the past pensioners is against our Constitution, The Central Government though said that the policy of 7th CPC will be continued, the validation clause is a ‘Damocles of sword’ over our heads and may fall at anytime in future to deny our rise and other rights according to retirement date. Though presently the 8th CPC which will be constituted shortly may not deny our rights, the Central Government armed with the powers to divide the Pensioners as per their year of retirement, may deny at any time for the past pensioners. The validation clause simply usurps the powers of the Judiciary, Constitution etc and arms the Central Government to deny and discriminate the past pensioners and the future pensioners.
The Forum of Civil Pensioners Associations watched with shock that the assurance held out by the Pension Secretary on 29.03.2025 in the online meeting the DoP&PW held with the members of the Staff Side JCM and the Pensioners Organisations for necessary clarifications also not released by the Government despite 4 months delay. This action increased the tensions and apprehensions of the community of Civil Pensioners.
Similarly on the question of formation of 8th Central Pay Commission for the CG Employees and Civil Pensioners also. Though the decision was taken by the Central Cabinet in January 2025, the actual constitution of the CPC and the release of its terms of references are unduly delayed up till now even after six months delay, causing us to concern.
The NCCPA (National Coordination Committee of Pensioners Associations) which presently with its 10 lakhs indirect members representing the 37 Affiliated Associations had formed the Forum of Civil Pensioners Associations with non-NCCPA Associations also to oppose unitedly the validation clause of Pension Rules and for immediate constitution of 8th CPC. As decided in the meeting of Forum of Civil Pensioners Associations on 10.06.2025, we are to combine our legal efforts with the Organizational efforts in opposition to the Validation Clause of Pension Rules and to continue our organizational efforts for the 8th CPC constitution.
We have conducted the Human Chain in the Districts involving crores of Pensioners as a first step. Now after the State level Convention we are marching to State Governors to submit this memorandum for onward transmission to the Honourable Prime Minister of the Central Government to withdraw the validation clause of Pension Rules adopted along with the Finance Bill 2025 in the Parliament and Gazette notified that also and to form immediately the 8th CPC with proper terms of references.
We see that the Civil Pensioners are alone not under severe attack by the Government. The Pensioners of BSNL-MTNL, the Banks, the LIC and the EPF are also under severe attack. The BSNL-MTNL Pensioners are denied their Pension Revision from 1.1.2017 and the Government after accepting the responsibility to pay the pension from the Government of India consolidated fund cannot deny the Pension Revision to BSNL-MTNL Pensioners. Similarly the Bank Pensioners are denied any Pension Revision for more than 3 decades and all the wage agreements reached once in 5 years are restricted to only the serving staff. The LIC Pensioners also of the same fate. The condition of EPF Pensioners are worse and with the amount sanctioned as Pension no EPF Pensioner can live. The suitable rise in the Pension to be granted by the Central Government immediately, instead of worrying only about Corporates and explain everything as not suitable to economy.
We solemnly request your Excellency the Governor to kindly accept and forward this memorandum to the Central Government.
