FORUM OF CIVIL PENSIONERS ASSOCIATIONS
Memorandum to Central Government through the Honourable Governor
We submit on behalf of the Civil Pensioners to his Excellency the Governor of _______ for onward transmission to the Central Government our grievance arisen due to the adopting of validation clause of Pension Rules along with the Finance Bill 2025 in the Parliament on 25.03.2025.
On 25.03.2025, the Central Government had adopted the Finance Bill 2025 but along with it adopted the validation clause of Pension Rules also as part of the Finance Bill. The adopting of Validation Clause is against the Article 14 of our Constitution as per the earlier Supreme Court Direction in the Nakara Vs Union of India case in 17.12.1982 delivered by the Constitution Bench headed by Chief Justice Sri.Y.V.Chadrachud. The Court had said that any division of the homogeneous class of Pensioners as per their retirement year and implementing from a prospective date any rise to the future pensioners is violation to Article 14 of the Constitution.
The Central Government, now, through the validation clause of Pension Rules is resorting to divide the Pensioners as per their retirement date. Thus dividing the same class of Pensioners into past and future pensioners as per their retirement date and denying any benefit to the past pensioners is against our Constitution, The Central Government though said that the policy of 7th CPC will be continued, the validation clause is a ‘Damocles of sword’ over our heads and may fall at anytime in future to deny our rise and other rights according to retirement date. Though presently the 8th CPC which will be constituted shortly may not deny our rights, the Central Government armed with the powers to divide the Pensioners as per their year of retirement, may deny at any time for the past pensioners. The validation clause simply usurps the powers of the Judiciary, Constitution etc and arms the Central Government to deny and discriminate the past pensioners and the future pensioners.
The Forum of Civil Pensioners Associations watched with shock that the assurance held out by the Pension Secretary on 29.03.2025 in the online meeting the DoP&PW held with the members of the Staff Side JCM and the Pensioners Organisations for necessary clarifications also not released by the Government despite 4 months delay. This action increased the tensions and apprehensions of the community of Civil Pensioners.
Similarly on the question of formation of 8th Central Pay Commission for the CG Employees and Civil Pensioners also. Though the decision was taken by the Central Cabinet in January 2025, the actual constitution of the CPC and the release of its terms of references are unduly delayed up till now even after six months delay, causing us to concern.
The NCCPA (National Coordination Committee of Pensioners Associations) which presently with its 10 lakhs indirect members representing the 37 Affiliated Associations had formed the Forum of Civil Pensioners Associations with non-NCCPA Associations also to oppose unitedly the validation clause of Pension Rules and for immediate constitution of 8th CPC. As decided in the meeting of Forum of Civil Pensioners Associations on 10.06.2025, we are to combine our legal efforts with the Organizational efforts in opposition to the Validation Clause of Pension Rules and to continue our organizational efforts for the 8th CPC constitution.
We have conducted the Human Chain in the Districts involving crores of Pensioners as a first step. Now after the State level Convention we are marching to State Governors to submit this memorandum for onward transmission to the Honourable Prime Minister of the Central Government to withdraw the validation clause of Pension Rules adopted along with the Finance Bill 2025 in the Parliament and Gazette notified that also and to form immediately the 8th CPC with proper terms of references.
We see that the Civil Pensioners are alone not under severe attack by the Government. The Pensioners of BSNL-MTNL, the Banks, the LIC and the EPF are also under severe attack. The BSNL-MTNL Pensioners are denied their Pension Revision from 1.1.2017 and the Government after accepting the responsibility to pay the pension from the Government of India consolidated fund cannot deny the Pension Revision to BSNL-MTNL Pensioners. Similarly the Bank Pensioners are denied any Pension Revision for more than 3 decades and all the wage agreements reached once in 5 years are restricted to only the serving staff. The LIC Pensioners also of the same fate. The condition of EPF Pensioners are worse and with the amount sanctioned as Pension no EPF Pensioner can live. The suitable rise in the Pension to be granted by the Central Government immediately, instead of worrying only about Corporates and explain everything as not suitable to economy.
We solemnly request your Excellency the Governor to kindly accept and forward this memorandum to the Central Government.

FORUM MEETING DECISIONS
Decisions of the ONLINE FORUM Meeting
Nearly 30 leaders representing the Civil Pensioners Associations, State Governemnt and the Banks attended the important online meeting of Forum of Civil Pensioners at 3.00 P.M. today (06.08.2025) convened by the Secretary General NCCPA Comrade K.Ragavendran. NCCPA President Comrade Shiva Gopal Mishra presided over the meeting and Comrade VAN Nmboodiri Patron NCCPA subsequently presided and concluded the meeting. The meeting reviewed the Human Chain 1st Phase of Programme of Civil Pensioners Associations and planned for the next phases of Programme and also the legal proceedings undertaken. Almost all the leaders placed their views. The following decisions are taken unanimously:
1) The meeting praised the rank and file for the successful and militant Human Chain Programme in all States and found a new enthusiasm amongst the Senior Citizen Pensioners in the newly formed Unity of Pensioners Associations.
2) The Meeting decided to fight the validation clause adopted by the Central Government irrespective of Government’s decisions on 8th CPC.
3) State level ‘Forum of Civil Pensioners Associations’ will be formed in all States and the Number of Office Bearers may be decided by the States themselves but there must be a Convenor, a President and a Treasurer. This State Body should plan for the success of all the remaining programmes.
4. The Civilian Pensioners Associations alone will be the signatories of the affidavit to court case but the Memorandum can be updated with Banks, LIC, EPF Pensioners and also the general aspect of BSNL MTNL Pensioners that no Pension Revision was allowed in these sectors.
5. Senior Advocate Kapil Sibal services was approved by the meeting. But the copy of the affidavit will be circulated to all Associations and their suggestions will be routed to the Advocate through comrade A..K.Kaushik by the Secretary General NCCPA.
6. State Bodies are empowered to decide about the submission of memorandum to the Honourable Governors either through a delegation or after a demonstration or after the Convention according to local conditions. However it is decided that it will be advisable to hold a demonstration and a delegation goes to the Governors to submit the memorandum.
7. Comrade I.S.Dabas should ascertain from the Police and all the state bodies should work hard for fulfilling the comrades to be brought to Delhi Dharna. No quota at CHQ to be fixed and Individual Associations should make the arrangement for stay etc of Delhi Chalo Comrades.
8. Associations not remitted their 1st instalment of Legal Fund are asked to remit early.

Implement the Programmes Effectively and REPORT
IMPLEMENTATION OF 10.06.2025 ONLINE FORUM OF CIVIL PENSIONERS ASSOCIATIONS MEETING
As decided in the online meeting of Forum of Civil Pensioners Associations on 10.06.2025, the struggle against the validation clause will be conducted at the Apex Court and also organizationally.
The Legal Committee will shortly send the affidavit by the Senior Advocate Kapil Sibel and the same will be exhibited in the whatsapp group shortly. So far nearly 10,00,000 rupees are received and the Associations not contributed are requested to remit the same at the earliest, as time at our disposal is short.
The organizational Programme of action in continuation of 3.4.2025 will be as follows:
1. Human chains at all District level on 25.07.2025.
2. State level united convention of Forum of Civil Pensioners Association and submission of memorandum (memorandum copy will be supplied by All India ) to State Governors for onward transmission to Central Government between 24.08.2025 and 28.08.2025l. As per local conditions, the March to Governor or a delegation to Governor can be on the day of convention or some other date between 24.08.2025 to 28.08.2025.
3. Meet the local Members of Parliaments (both Loksabha and Rajyasabha) and ask their support from 07.09.2025 to 14.09.2925 by giving our Memorandum Copy.
4. Organize Press Meet in State Headquarters between 20.09.2025 and 23.09.2025 and give our copy of memorandum and programme of action for good publicity.
5. Delhi Chalo and submission of memorandum to President of India; Prime Minister of India; and Chief Justice of India on 11.10.2025. Time of Delhi Chalo at Jantar Mantar and time for delegation to meet the President, Prime Minister and the Chief Justice will be intimated shortly.

Letter to Civil Pensioners Associations
Dear Comrades!
Intention
of validation amendment:
If any Pensioner goes to any Court and claims a
particular benefit, the govt can argue by releasing an OM that the benefit was
applied to the present pensioner only and not applicable to the past
Pensioners. So not only the S-30, but also the AIPRPA and the Incometax retired
commissioner who are in the court demanding higher scale of the serving
employee from a prospective date to the past Pensioner can be denied of their
prayer.
Why 1972? It is because those retired past
pensioners in 1971will be 103 years old and above and they normally should not
be survived. So no past Pensioner can go to any Court. That is why 1972.
So at any future, the govt may or may not give
any benefit to past Pensioners because it is armed with validation amendment!
This validation amendment is actually a danger to the pension system even.
Despite the Government’s averment, the
validation amendment causes the Pensioners only a ‘panic’. Moreover, the
amendment from 1972 onwards and compartmentalizing the Pensioners into year of
their retirement, against the Supreme Court’s ruling that it will be violation
of the Article 14 of Constitution if the same class of Pensioners are divided
into batches according to the year of retirement is definitely an attack on the
Pensionary rights. The S-30 Pensioners victory in Delhi High Court and the
argument of DoP&PW Secretary there after the validation amendment is clear
proof of Government’s intentions.

The meeting of Pensioners Associations created a
forum called ‘Forum of Civil Pensioners Associations’ to fight the move of the
Government both legally and organizationally, Such WhatsApp group also for
exchange of ideas is created as per the decision of 10th June online meeting.
If any organization is left out, please suggest inclusion of Chief Executive
and President of that organization for inclusion either in the group itself or
in 944919295.
Legal fight and our tasks:
The legal fight will be carried on either
engaging Senior Advocates Kapil Sibal or Varun Singh, Delhi based committee
will look after that before 17th June and the Advocate to be engaged will be
finalized. Which advocate of the two, charges us less will be engaged as
we are Pensioners Assn basically. It is estimated that around 40 Lakhs rupees
will be the expenditure to take up the case in Supreme Court. No single
organization could afford to that kind of money & even if can afford, it
will be a big strain on the finances of such Assn. And therefore the decision
of the meeting is to divide the expenses judiciously among the Civil Pensioners
Associations. It is suggested that bigger organization will bore the expenses
to the tune of 4-5 lakhs and other Associations will give legal fund to the
Forum to the tune of 100,000 to 10,000 as per list so that we can muster the
necessary funds for the Supreme Court. All the chief executives of those
organisations will be included in the affidavit to be filed. The brake up
is given in the list and you may give your opinion on that.
Combining
legal and organizational Programmes:
The Collections are generally from the members
and to keep them serious we decided to merge both legal and organizational form
of protests together. The Organisational programmes are like “Human Chain in
Districts; State level conventions and March to Governor to submit our
Memorandum; Meet the Parliament Members in all Districts and also holding Press
Conferences at State level; and Delhi Chalo Programme including submission of
Memorandum to Honourable President of India, Prime Minster of India and Chief
Justice of India”. Kindly give your opinion and the dates and month of the
above Programmes, so that we can finalize the Programmes.

20th May Strike - let it be a great working class action!!
On 20.05.2025, the Indian Working Class is to stage a great protest by its nationwide strike. The strike action and a series of programmes were decided by the National Convention of Workers. NCCPA or National Coordinating Committee of Pensioners Associations that met in its National Executive on 19.04.2025 at AIRF office in New Delhi unanimously decided to solidly support the working class action.
It calls all the 10 lakhs of its members to solidly stand with the Central TUs & Independent Federations and Associations and resort to jail baro; rasta roko and other forms of programmes decided by the Central TUs and Federations.
On behalf of NCCPA we express total support to the programmes of Central TUs and Federations.

Great news that the Postal JCA of NFPE and FNPO and many of their affiliates have decided to join the Working Class action on 20th May!
The decision is stupendous and we the NCCPA is very happy that the Postal JCA has decided for united action. We trust and hope that as per tradition, the Confederation also takes a similar positive stand and joins the action. Liberalisation and Privatisation policy of the Government cannot be driven back unless there is united action of everybody.

Government do not like Court Verdicts that is against it!
This Newspaper clearly saw that the Supreme Court which struck down the dealings of the Government and ruled that all past pensioners are to be treated in the same manner is turned back and now the Government has got back the powers to accept or deny a benefit recommended by CPCs. The real purpose of validation amendment is to win the Supreme Court which ruled that the pensioners of pre2006 should be given like post2006 pensioners ìn the case that went before it called the S-30 pensioners case. To abrogate all powers that the Supreme Court had stripped down, the Government passed this amendment!
Now, all past pensioners are at the mercy of Government! Why not we challenge the validation amendment illegal at the Supreme Court? NCCPA will decide on 19th April in the Delhi Executive! - KR SG NCCPA

Declaration
adopted by the demonstrating pensioners on 03.04.2025 and submitted to the
Honourable Prime Minister through the Head of the Department / Head of office
of CG Office in States & Districts:
The Action of the Central Government
on 25.03.2025 to adopt the bill along with the Finance Bill in the name
of ‘Validation of the CCS (Pension) Rules and principles for expenditure on Pension Liabilities from the Consolidated
Fund of India’ to dupe the Members of Parliament is very
retrograde. The opposition to the effort was steam rolled by the Government in
Parliament and the purport of the bill to usurp the right to classify the
pensioners community into different groups based on their retirement and thus
deny them to the benefits of future pensioners is actually tramples the ruling
of the Supreme Court in the landmark judgment of D.S.Nakara case which ruled
that any attempt to divide the same class of pensioners by artificial cut-off
date and thus deny the benefit to a section of pensioners is violative of
Article 14 of the Constitution.
The bill actually robs all the
pensioners and the action of the Government to attack the senior citizens are
detestable.
To announce a Central Pay Commission and before appointing it adopting a bill
to deny any right to the past pensioners through the Pay Commission is most
retrograde. The Honourable Finance Minister tried to bring solace to the
pensioners community by saying that the existing pension will not be affected by the
distinctions created amongst the past pensioners; but she did not say that through
the 8th Pay Commission the past pensioners will not be
compartmentalized and the past pensioners also will be eligible to the rights
of the future pensioners like 7th CPC.
The DoP&PW organized a virtual
meeting on 29.03.2025 at 10.30 A.M. The Staff Side including the Staff Side
Secretary and many leaders of the Pensioners Movement were present.The Pension
Secretary repeatedly saying that the validation was only to regularise 6th
CPC times and the present Government will continue the polices of 7th
CPC and that no change of policy is contemplated, He will issue a clarification
also on behalf of Pension Ministry. But the doubts persist and there is no need
to revise the validation time from 1972 onwards. The Pension Secretary had no
answers to this question.
This demonstration of the Pensioners
organized by the NCCPA and its Affiliates and other Pensioners Associations
vehemently condemns the action of the Union Government forced by the
liberalization and pension reforms and the community of Pensioners have no alternative but to turn to the streets for
justice.

Sub: Letter of DOPT addressed to Staff Side Secretary
on 8th CPC Terms of Reference - Reg.
Kindly consider the following points while finalizing
the letter on terms of reference to 8th CPC by the JCM Staff Side to
the DOPT.
NCCPA Will be thankful to the staff side for writing
the undermentioned points also to the DOPT in addition to other points in
response to the said letter:
1. While framing the terms of reference
to 7th CPC, the words “Autonomous and Statutory Bodies” was left out while
mentioning the CG Employees and Pensioners. This omission unnecessarily delayed
the functioning of the 7th CPC and the acceptance of the recommendations to the
Autonomous and Statutory Bodies by the Government.
2. Comprehensive terms of reference
about medical issues is required to deal the inclusion of Autonomous and
statutory Bodies as well as the Ayurveda retirees.
3. Inclusion of CGHS to the NPS
Pensioners require amendment for the NPS Pensioners like the CCS Pension 2021
covered Pensioners as the period should be 9 years 9 months for both. The issue
may please be referred to the 8th CPC.
4. All issues recommended by the
Parliamentary Standing Committee regarding CGHS / Medical and Pension, which
were earlier rejected by the Central Cabinet shall be included in the terms of
reference. The issue of one wellness centre at least in each revenue district
may be referred to 8th CPC.
5. All current issues in the court or
direction from the courts shall be included for the recommendation of the 8th
CPC. The issues like the reduction of period of restoration of Commutation; the
FMA quantum; the issue of continued impounding of 18 months DA/DR Arrears;
Commutation restoration etc are referred to 8th CPC.
6. The issue of extending recognition to
eligible Pensioners Associations of All India and States for admittance in
SCOVA and Pensioners Portal in a democratic manner shall be included in the
terms of reference. Similarly, the issue of enacting a national litigation
policy may be referred to the Pay Commission.
