Intention
of validation amendment:
If any Pensioner goes to any Court and claims a
particular benefit, the govt can argue by releasing an OM that the benefit was
applied to the present pensioner only and not applicable to the past
Pensioners. So not only the S-30, but also the AIPRPA and the Incometax retired
commissioner who are in the court demanding higher scale of the serving
employee from a prospective date to the past Pensioner can be denied of their
prayer.
Why 1972? It is because those retired past
pensioners in 1971will be 103 years old and above and they normally should not
be survived. So no past Pensioner can go to any Court. That is why 1972.
So at any future, the govt may or may not give
any benefit to past Pensioners because it is armed with validation amendment!
This validation amendment is actually a danger to the pension system even.
Despite the Government’s averment, the
validation amendment causes the Pensioners only a ‘panic’. Moreover, the
amendment from 1972 onwards and compartmentalizing the Pensioners into year of
their retirement, against the Supreme Court’s ruling that it will be violation
of the Article 14 of Constitution if the same class of Pensioners are divided
into batches according to the year of retirement is definitely an attack on the
Pensionary rights. The S-30 Pensioners victory in Delhi High Court and the
argument of DoP&PW Secretary there after the validation amendment is clear
proof of Government’s intentions.

timely exchanges for our Forum:
The meeting of Pensioners Associations created a
forum called ‘Forum of Civil Pensioners Associations’ to fight the move of the
Government both legally and organizationally, Such WhatsApp group also for
exchange of ideas is created as per the decision of 10th June online meeting.
If any organization is left out, please suggest inclusion of Chief Executive
and President of that organization for inclusion either in the group itself or
in 944919295.
Legal fight and our tasks:
The legal fight will be carried on either
engaging Senior Advocates Kapil Sibal or Varun Singh, Delhi based committee
will look after that before 17th June and the Advocate to be engaged will be
finalized. Which advocate of the two, charges us less will be engaged as
we are Pensioners Assn basically. It is estimated that around 40 Lakhs rupees
will be the expenditure to take up the case in Supreme Court. No single
organization could afford to that kind of money & even if can afford, it
will be a big strain on the finances of such Assn. And therefore the decision
of the meeting is to divide the expenses judiciously among the Civil Pensioners
Associations. It is suggested that bigger organization will bore the expenses
to the tune of 4-5 lakhs and other Associations will give legal fund to the
Forum to the tune of 100,000 to 10,000 as per list so that we can muster the
necessary funds for the Supreme Court. All the chief executives of those
organisations will be included in the affidavit to be filed. The brake up
is given in the list and you may give your opinion on that.
Combining
legal and organizational Programmes:
The Collections are generally from the members
and to keep them serious we decided to merge both legal and organizational form
of protests together. The Organisational programmes are like “Human Chain in
Districts; State level conventions and March to Governor to submit our
Memorandum; Meet the Parliament Members in all Districts and also holding Press
Conferences at State level; and Delhi Chalo Programme including submission of
Memorandum to Honourable President of India, Prime Minster of India and Chief
Justice of India”. Kindly give your opinion and the dates and month of the
above Programmes, so that we can finalize the Programmes.
